* Case C-512/99, Germany v Commission
Germany asked the Commission to confirm under Article 100A para 4 EC Treaty that it could introduce new, stricter provisions with regard to the classification, packaging and labelling of a particular type of dangerous substances, namely man-made mineral fibers. The Commission decided on this request only after the entry into force of the Treaty of Amsterdam, which changed the rules of the game. Under Article 95 para 5 EC Treaty, for such new stricter national provisions a set of requirements needs to be fulfilled. The German request – made as already explained under the old regime – did not meet the requirements of the new regime and the Commission rejected it. The ECJ confirms that the Commission could do this, in spite of not having told Germany that it would consider the request under the new rules of the EC Treaty rather than the old ones.
