The judgment backs the right of the Danish government to apply the EC treaty’s “environmental guarantee” clause of Article 95(4). It clarifies and strengthens the right of member states to maintain environmental or public health controls stricter than subsequently agreed in an EU harmonisation law.

Environment ministers from 25 countries (the present and acceding countries) gathered in Athens, Greece at an informal meeting to discuss future impacts of the proposed European Constitutional Treaty. They agreed that the way the proposals stand now, they do not reflect the environmental achievements reached so far (documents uploaded in this respect include the Presidency Conclusions, Commission non-paper, Background paper, speech by Ms. Vasso Papandreou, press conference materials).
