* Case C-458/00, ECJ 13 February 2003, Commission v Luxembourg Incineration of household waste forms a disposal rather than a recovery operation because the main aim of burning the waste is not energy generation and replacement of other fuel; if it was not for the waste, no energy would be generated. This enables national authorities to strive for self-sufficiency.

* C-228/00, ECJ 13 February 2003, Commission v Germany Incineration of waste in cement kilns forms a recovery rather than a disposal operation because the main aim of burning the waste is energy generation and replacement of other fuel; if the waste would not be used, energy would need to be generated by means of other fuel.

This stands in the way of striving for self-sufficiency by national authorities.
